According to the National Institute on Drug Abuse, in 2016, there were 396 opioid-related overdose deaths in Minnesotaa rate of 7.4 deaths per 100,000 persons compared to the national rate of 13.3 deaths per 100,000. The death rate has been steadily increasing since 2010 when the rate was 4.4 deaths per 100,000. From 2009 to 2016, the number of heroin-related deaths increased from 16 to 149; deaths related to synthetic opioids rose from 39 to 99; and deaths from prescription opioids remained stable from 177 to 195. Research also revealed that in 2015, Minnesota providers wrote 54.2 opioid prescriptions per 100 persons compared to the average U.S. rate was 70 opioid prescriptions per 100 persons.

The incidence of Neonatal Abstinence Syndrome in Minnesota Medicaid claims data (accounting for about 80 percent of opioid-affected births) has increased from 5.9 per 1,000 births in 2009 to 10.5 per 1,000 births in 2012, an almost twofold increase.

In the state of Minnesota, medical marijuana was legalized on May 29th of 2014. Minnesota has one of the strictest medical marijuana programs in the country. Medical marijuana is available to anyone who has been certified by a healthcare provider of suffering from conditions including Glaucoma, HIV/AIDS, Cancer, Tourette's Syndrome, ALS, Seizures, Severe and muscle spasms, Crohn's disease, PTSD, Autism, Obstructive Sleep Apnea, Intractable pain, and Terminal Ilness. In Minnesota, medical marijuana can only be consumed in the form of a liquid, pill, topical cream, or oil concentrate. According to the Minnesota Department of Health, there are 1513 health care paractitioners that are registered and authorized to cretify patients. There are 24,405 registered patients; however, 16,270 patients are currently active in the registry.

According to the Minnesota Department of Health, there are 1,456 patient caregivers that have been approved in the registry. Patients who require extra help can use their registry account to invite caregivers to assist them in picking up medical cannabis from a cannabis patient center or in administering the medical cannabis. There are two different groups of caregivers in the Minnesota medical cannabis program: designated caregivers and parents or legal guardians acting as caregivers. All caregivers must be enrolled in the patient registry system. A patient's parent or legal guardian may act as caregiver and be entered in the registry without having to qualify as a designated caregiver. A patient may have both registered designated caregivers and registered parents or legal guardians acting as caregivers.

In the state of Minnesota, recreational marijuana is illegal; however, three bills have been introduced in the Minnesota state legislature aiming to legalize it. With the proposal adults over the age of 21 would be able to buy marijuana. The regulation of sale, marketing and manufacturing of marijuana would run through the state Department of Health, just like the medical cannabis industry today. Residents would be able to grow up to four of their own plants, with a license. Every municipality in the state would have say over how many retailers could operate, cities could opt out of allowing retailers. Public consumption would not be allowed. In Minnesota, it is prohibi ted to smoke dry herbs/marijuana flowers. Possession of 42.5 grams or less is a misdemeanor punishable by a maximum fine of $200. Possession of 42.5 grams and above is considered a felony. Imprisonment of up to 30 years and a maximum fine of $1,000,00 is given, according to the amount of weed found during questioning. Possession of more than 1.4 grams inside one's vehicle (except the trunk) is a misdemeanor, punishable by a maximum sentence of 90 days imprisonment and a maximum fine of $1,000.
